A Florida court of appeals affirmed the trial court's ruling and held that a Florida stature failed to provide for a appointment of a guardian for a fetus in an instance where a mentally retarded woman who was sexually abused became pregnant but was unable to provide for her own care and make her own decisions. The court further concluded that the state is not required to appoint the fetus a guardian because to be appointed a guardian, a fetus must be regarded as a person; however, under Florida law, a fetus is not a person. Additionally, the law safeguards the interests of the fetus because a guardian cannot authorize an abortion of the fetus unless two physicians make a certification in writing as to the pregnant woman's health and the guardian obtains authority from the court to consent to the abortion. Update Back to Top Scott Thomas Scott Thomas sustained a brain-injury in September 2004 at his home that incapacitated him and left him in need of constant care, including the use of a feeding tube. In a case similar to Terri Schiavo's, this 34-year man from Jacksonville is embroiled in a court battle to retain care from his mother Pamela Patton who cares for him on a daily basis, which has resulted in an improvement. However, for nearly two years his wife Liza Scott wishes to gain co-guardianship. If the wife succeeds in her petition to the court this could result in Scott being transferred to a nursing home or hospice, which will jeopardize his care.
